buybacwaterusa.com (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website, we will respond expeditiously to notices of alleged copyright infringement that are reported to our Designated Copyright Agent identified below.
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website, buybacwaterusa.com (the “Website”), by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
1. Notice of Alleged Infringement (DMCA Notice)
To file a notice of infringement with us, you must provide a written communication (by mail or email) that includes the items specified below. Please note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is infringing your copyrights.
Your DMCA Notice must include the following information:
-
Identify the copyrighted work that you claim has been infringed, or—if multiple copyrighted works are covered by this Notice—you may provide a representative list of the copyrighted works that you claim have been infringed.
-
Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, the URL of the link shown on the Website or the exact location where such material may be found.
-
Provide your contact information, including your company name (if applicable), mailing address, telephone number, and email address.
-
Include both of the following statements in the body of the Notice:
-
“I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
-
“I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
-
-
Provide your physical or electronic signature (typing your full legal name at the bottom of an email is sufficient).
2. Where to Send Your Notice
Deliver this Notice, with all items completed, to our Designated Copyright Agent at the following address:
Designated Copyright Agent
buybacwaterusa.com
Attn: DMCA Copyright Agent
Mailing Address: PO Box 62, Randolph, NE 68771
Phone: 402-882-2323
Email: support@buybacwaterusa.com
(Please include “DMCA Infringement Notice” in the subject line if submitting via email).
3. Counter-Notification Procedure
If you receive a notification that material you posted on our Website has been removed or disabled due to a copyright infringement claim, and you believe that the material was removed by mistake or misidentification, you may submit a Counter-Notice.
To be effective, a Counter-Notice must be a written communication sent to our Designated Copyright Agent and must include substantially the following:
-
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
-
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
-
Your name, address, telephone number, and email address.
-
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you reside outside the United States, that you consent to the jurisdiction of the Federal District Court for the District of Nebraska), and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
-
Your physical or electronic signature.
Upon receipt of a valid Counter-Notice, we will forward it to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, the removed material may be replaced or access to it restored in 10 to 14 business days after receipt of the Counter-Notice.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances and at our sole discretion, users, account holders, or system access privileges of those who are deemed to be repeat infringers.
